Evidence In DUI/OVI Cases
The evidence in these cases comes mostly from polices officers’ observations and chemical tests for blood/breath/urine.  Officers are trained to look for evidence of intoxication when a vehicle is in motion and during the officer’s personal contact with the driver.  If the officers observe evidence suggesting a driver is under the influence, they will administer field sobriety tests.  If the officer concludes the driver is probably under the influence, the officer arrests the driver and requests that the driver submit to a blood test, urine test, or breath test.  The result of the test, if competed, may be used as evidence in court.
