When an individual is charged with vehicular assault in Ohio, the prosecution must prove the driver caused serious physical harm to another person while operating a vehicle under the influence, or recklessly. The level of the offense charged and the potential penalties depend on whether the driver was under the influence or reckless.
If the prosecution proves the driver was under the influence, vehicular assault is a felony of the third degree, punishable by up to five years in prison and a driver’s license suspension of up to ten years.
If the prosecution proves the driver was operating recklessly, vehicular assault is a felony of the fourth degree, punishable by up to 18 months in prison and a driver’s license suspension of up to five years.
