If you have previously been convicted of a DUI and have been charged with multiple DUIs within six years, you will face severe penalties. With each conviction, the severity of the following penalties will increase.
Second DUI Offense
For a second Ohio DUI offense within six years, the minimum jail sentence is ten consecutive days, and the maximum jail sentence is six months. The license suspension will range from one to five years. You will also receive mandatory yellow license plates, ignition interlock device, vehicle immobilization for 90 days and alcohol treatment program(s).
Third DUI Offense
For a third Ohio DUI offense within six years, the minimum jail sentence is 30 days and the maximum jail sentence is one year. The license suspension will range from two to ten years. You will also receive mandatory yellow license plates, ignition interlock device, vehicle forfeiture, and alcohol treatment program(s).
Felony DUI
If you are convicted of a fourth Ohio DUI in six years or a sixth Ohio DUI in 20 years, the offense is categorized as a felony. For a first felony DUI conviction, the minimum term of incarceration is 60 days and the maximum time in prison is 30 months. The license suspension will range from three years to life. A first felony DUI conviction also results in mandatory yellow license plates, ignition interlock device, vehicle forfeiture and alcohol treatment program(s).
For a second felony DUI conviction, the minimum prison sentence is 120 days and the maximum prison sentence is five years. The license suspension will range from three years to life. A second felony DUI conviction also results in mandatory yellow license plates, ignition interlock device, vehicle forfeiture and alcohol treatment program(s).
