Involuntary Manslaughter and the Charges Filed Against you

The prosecution must prove the driver caused the death of another person as a result of their committing a felony offense or a misdemeanor offense.

If you are charged with killing an individual while committing a felony, then you will be charged with a felony of the first degree, punishable by up to ten years in prison. If the underlying offense is a misdemeanor, the involuntary manslaughter is charged as a felony of the third degree and is punishable by up to five years in prison.

If the underlying offense is DUI or DWI, then the court must impose a prison term and must impose a life-long driver’s license suspension.
